General terms and conditions for guests and participants
of the deltaconX EMIR REFIT Training Day
A. Introduction
The following General Terms and Conditions govern the contractual relationship between

conference attendee(s) and
-
the conference organizer (deltaconX AG, Hertensteinstrasse 51, CH-6004 Lucerne, Switzerland) for participation in the EMIR REFIT Training Day.
B. Included services & Registration fees
B.1. The registration fee for each conference attendee is € 499,00 (exclusive of Austrian VAT), or € 249,00 (exclusive of Austrian VAT) for existing deltaconX customers.
Travel, subsistence, or accommodation expenses are not included in the all-inclusive prices mentioned in point B. The prices are exclusive of Austrian VAT.
C. Scope
The conditions defined in the registration forms and the General Terms and Conditions stated herein shall apply to contracts relating to participation in the services mentioned in points B above.
D. Registration
Registration for the EMIR REFIT Training Day conference can be done online. Registration constitutes a legally binding offer to conclude a contract. The contract to provide services outlined in section B shall only become binding upon receipt of our written confirmation (by e-mail). Upon receipt of your registration, we will send you a confirmation and an invoice, which we require you to pay by the calendar date specified. Participation in the EMIR REFIT Training Day event mentioned in point B is only possible if full payment is received in our account before the conference takes place. On-site registrations are not possible. If any portion of the invoice is still unpaid on the date of the conference, the attendee or guest will not be entitled to participate in the services outlined in point B. By purchasing a ticket the attendee acknowledges and agrees to abide by the legally applicable provisions relating to the Covid-19 pandemic. In the event of non-compliance with any relevant Covid-19 provisions access to the conference can be refused without possibility of refund for the ticket(s). By purchasing a ticket the attendee agrees to abide by the house rules as well as terms and conditions of the organizer. Each ticket is valid for one attendee once successfully identified. Any resale of tickets is expressly prohibited.
E. Cancellation
The conference organizer shall be entitled to cancel EMIR REFIT Training Day at any time due to organisational, economical or other important reasons (e.g. force majeure, insufficient registrations, et cetera) and terminate the contract accordingly. If the conference is cancelled by the organizer, all ticket fees will be refunded in full. Further claims for compensation are excluded.
Due to national and local restrictions caused by the Covid-19 pandemic, the organizer is entitled to cancel the event.
F. Changes in the conference programme
The organizer may change the programme (for instance change of speakers, cancellation of presentations, et cetera). This will not entitle the conference participant or the companion to any compensation.
G. Copyright, visual recordings
Any conference documents (presentation slides, et cetera) are protected by copyright. Any disemination and/or reproduction of conference documents is not allowed.
H. Liability
All types of claims for damages against the organizer shall be excluded, provided that no intentional wrongdoing or gross negligence has occurred.
The conference organizer cannot be held responsible for any personal injury and losses or damages of objects belonging to the conference participants or companions – with the exception damages arising from the organizers intentional wrongdoing or gross negligence. Liability for mild neglice, compensation for resulting damages, loss of revenue, unachieved savings, interest loss, or damages from third parties against attendees are also excluded. In the event of changes to the agenda, cancellations of speakers, or any rescheduling, the organizer is not liable for any expenses incurred relating to travel, hotel, pre-payments, or shipping expenses. The organizer reserves the right to eject and exclude any attendees who are intoxicated, aggresive, beligerent, or otherwise incapacitated without penalty. Any willful non-compliance with any safety instructions, any disturbance of the peace, or viloation of the relevant legal regulations can also lead to ejection from the event.
I. Cancellation policy
Attendees may withdraw from the contract at any time. Only written cancellations will be accepted. If a cancellation request is received, a cancellation fee of 50% of the prices mentioned in point B will apply. If a cancellation request is recieved after September 30th 2022, a cancellation fee of 100% of the prices mentioned in point B will apply. In case of non-attendance we will charge the price in full mentioned in point B. We will be pleased to accept a substitute nominated by you.
J. Final Provisions
In the event that any provision of these General Terms and Conditions is invalid in part or in full, or in the event that the contract is unenforcable, it shall not affect the validity of any other provisions of the contract or parts of these provisions. Any invalid or missing provisions shall be replaced by the applicable legal regulations.
In the case of any disputes arising from this contract, swiss law shall apply.
The sole court of jurisdiction for any claims resulting from the contract associated with these General Terms and Conditions shall be Lucerne, Switzerland.
